Does Confession mean Admission?

Admissions is a statement made by any a party or authorized representative. It must be made voluntarily without any threat or inducement. Admission must be related to the fact in issue or relevant fact. Therefore, all confession is admissions, but every admission may not be a confession.

According to Section 17 of the Evidence Act, 1872- Admission is a statement of fact oral or documentary or (contained in electronic form) made by a party or a person connected with the subject matter of the suit.

According to Sir Stephen- Admission is a statement oral or written as to the fact in issue or relevant fact made by a person or on his half to any proceeding is called admission.

For example- A says to B that he stole money from C, A makes an admission of the fact that A stole money from C.

Value of Admission:

Admission is very weak kinds of evidence. The court has the power to reject an admission. If the court court finds that the admission is untrue. Section 31 of the Evidence Act provides that an admission is not conclusive proof of matters admitted, but they are operating as estoppels after given i.e. the person can not deny it.

The effect of admission is that the party who make the admission may be presumed to be true until contrary is proved or shown. The value of the admission depends upon the circumstances in which it was made.

An admission must be taken as a whole, because the true meaning of the statement can not be ascertained from the part of the statement. NOTE-Oral admission is given a lesser weight then the written.
