Public Prosecutors are appointed by the government i.e. Ministry of Law in each district and Metropolitan Sessions Court. Their main function is to look after the criminal cases for and against the government.
The word prosecutor is derived from the Latin word procure which means care, secure, protect. A public prosecutor is the chief law enforcement officer of the government, and represents the government's interest in criminal trials. The prosecutor is bound by the law, to act as a legal representative of the government.
Public Prosecutor, means any person appointed under section 492, and includes any person acting under the directions of a Public Prosecutor. Simply the public prosecutor is the government's lawyer when prosecuting crimes committed against the people.
Qualifications of the Public Prosecutors
(1) A person shall be appointed as a Public Prosecutor-
(a) Who is a citizen of Bangladesh.
(b) Who has obtained a degree in Law from any statutory University and has been enrolled as an advocate.
(c) Who is not more than fifty-five years of age on the date of appointment.
(d) Who has been in practice as an advocate.
(2) A Public Prosecutor or Assistant Public Prosecutor should have been in practice as an advocate for not less than seven years.
(3) He must have been a practice as an advocate for not less than ten years for the appointment of a Special Public Prosecutor.
